Im in the process of filing a new GC in EB2 category which eventually I will port to my older EB3 application. I wanted to find out if we need to do our Medical exam again during the I-485 stage?

Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

My wife and my documents were delivered on June 6th and receipt date June 14th. My AP was approved on July 20th. However, my wife's is still pending though there are two date update since mine is approved - July 22nd and 27th. Anyone has the same situation?

Hi,
My labor was denied first time through PERM(December 2005) and later after refiling, it got approve through PERM ( Applied on May 2006)
Now Can I use my first labor filing date as the priority date(Decmber 2005) or they will take the new date(May 2006).
I have I-140 Approved.

I am not sure if this has been ever discussed or no but will appreciate any pointers on it : Can one keep extending the H4 visa even if EAD is been used?

H4 goes void once u start using EAD.So where is the question of extension of h4.???If u donot use EAD,u can parallelly extend ur h4 visa until ur petitions are pending.

And it is reinforced by a massive poll released last week by Andrew Kohut and the Pew Research Center for the People and the Press.
The survey of 2,007 people, conducted in December and January, depicts a dramatic shift in Americans' attitudes, opinions and values between 1994, when Republicans took control of Congress, and now. Most of the change has occurred since George Bush took office in 2001.
The poll, which can be found at http://www.people-press.org, is a treasure trove of information about Americans' views of the parties, government, the world scene, religion, the economy, business, labor and a dozen other topics.
But a word of caution is in order. There is little here that suggests voters' opinion of Democrats is much higher than it was when they lost Congress in 1994. It seems doubtful that Democrats can help themselves a great deal just by tearing down an already discredited Republican administration with more investigations such as the current attack on the Justice Department and White House over the firings of eight U.S. attorneys.
At some point, Democrats have to give people something to vote for. People already know what they're against -- the Republicans.

Our AP expires on August 30 and we don't have any plans to travel this year. We have only plans for next summer.
Do I still need to get my AP renewed now? or Can I start my renewal process in next spring?

No. You can file two I-140 petitions from the same employer and your approved H-1B for three years is not in trouble. I don't blame you for your deepest concern in this issue, as USCIS made each and everyone of us so concerned about our every walk of our life.

Some of my friends who are in their final year of a residency program on a H1b (non profit) have got job offers from profit organizations and their H1b transfer is subject to cap. Their transfer will be done only in May/June 2007 and now they are stuck because of the cap limit.
A lot of people in same situation are IV members. SOme organized effort is required to this cause.
These maybe people who could not file for their "real" jobs when cap was reached.
Must we not start an organized effort and let our law makers know about this situation.

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.

I am on EAD and I dont have any current employment, except a good faith future employment offer. I am already in bench more than 4 months and tired of it. I want to travel to India and come back after 2 months, using AP. What sort of questions being asked while entering USA and what documents I need to provide?
My friends are advising me not to leave the country. Please advise.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

My company filed a new PERM application recently. I have a EB3 I-140 approved from my old employer ( Approved in August 2009). My attorney had filed the new PERM and requested to capture the same date. Will this cause any problems? Below is the question that is asked in ETA9089 form.
1. Are you seeking to utilize the filing date from a previously submitted application for Alien Employment Certification (ETA 750) ?

When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.

I lost my original passport and was issued a new passort which is valid till 12 feb 2007. I mailed my application to the indian consulate but they stamped the extension of passport for 1 more year. The first page of the passport say it expires the on 12th feb but on the next page th consular general stamped the extension of the passport till 12th jan 2008. I am goin to india on 26th jan for H1b stamping. I wanted to know what are the chances of the visa getting rejected at the US embassy. Alsp is the passport valid for travel

I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?
